A new bill would make it illegal for Florida drivers to hold their phones on the road.

The hands-free bill is being revived after the state’s last session, and it would focus on expanding the state’s ban on texting and driving. If the bill is passed, it will take effect on October 1st, 2026.
According to FloridaPolitics.com, the bill would make it illegal for drivers to make calls on the road, hold the phone, or even rest it on their laps. The bill, which is titled SB 1152, says “‘Handheld manner’ means holding a wireless communications device in one or both hands or physically supporting the device with any other part of the body.”

The bill would include anything from cell phones to laptops and even gaming devices under this description. It won’t impact first responders or include small radios or in-vehicle systems. If caught violating the law in a school zone or past construction workers, drivers will receive a $150 fine and 3 points off their license.

If caught again, a second fine will be $250 and 3 more points off their license. A third offense would result in a $500 fine, 4 more points against the license, and a 90-day suspension of their license. The bill first appeared in the 2024 Session, where it passed the House but was never scheduled for the Senate.

Driving in Florida
During the 2025 Legislative Session, the bill reemerged and passed in the Senate. In reversal of the previous year, the bill was never scheduled for the House. According to the NHTSA, roughly 3,275 lives were lost in 2023 due to distracted driving.

Don’t be distracted!
The NHTSA describes distracted driving as “any activity that diverts attention from driving, including talking or texting on your phone, eating and drinking, talking to people in your vehicle, fiddling with the stereo, entertainment, or navigation system.” It also clarifies that texting is the most alarming distraction.

Be aware when driving
The bill currently doesn’t have a House companion. It’s customary to introduce identical bills in both houses simultaneously, which creates what we know to be “companion bills”. They’re almost identical, including titles, except in the resolution and concurrent resolutions, according to the Florida Legislator. They’re similar, and the use of companion bills allows for analysis and deliberation by both houses at the same time.
